3 General provisions about Port Management

3.1 Control

3.1.1 Compliance with Signs and Notices

Compliance is required, at all times, with any Port Notices physically erected in the port and all other directory signs, notices, traffic signs or other signs erected, displayed or promulgated within the port.

3.1.2 Erecting Signs

No person (other than the Authority) may erect any sign in the port, port lands, facilities, boat ramps, small craft facilities or any land / facility under the control of Mackay Port Authority without first obtaining written permission from the Authority.

3.1.3 Direction

All persons must comply with any direction or instruction given by an Authorised Officer.

3.1.4 Permits

Permission must be obtained from Mackay Port Authority for certain prescribed activities / works within the port including, but not limited to:

  • (a) Hot work – on or within facilities or ships
  • (b) Excavations / trenching
  • (c) Fumigation
  • (d) Diving / underwater activities
  • (e) Bunkering by road tanker
  • (f) Sand blasting and other types of blasting
  • (g) Erection of temporary or permanent structures
  • (h) Immobilising a ship
  • (i) Operation of propellers at a wharf
  • (j) Placing of buoys / moorings
  • (k) Heavy lifts
  • (l) Hull cleaning
  • (m) Clean fill discharge

The requirements of the Port Notices do not absolve the need to obtain any approvals, licences or permits which may be required by law.

3.1.5 Obstruction

No person must obstruct, without a reasonable excuse, an Authorised Officer in carrying out their duties in relation to inspection of documents, ships, goods and vehicles.

3.2 Entry

3.2.1 Entry and Exit

No person may enter or leave the port area by land other than by the designated entrances and exits of the port.

3.2.2 Authority to Enter

No person may be in the port, including small craft facilities, without a lawful justification or excuse, or authorisation.

3.2.3 Unauthorised Access to Work Site

No person may enter any place within the port where work or construction is occurring, such as wharves, construction sites, ships being worked on, areas where plant and machinery are operating or maintenance work being undertaken etc, without authorisation of the Authority.

3.3 Conduct

3.3.1 Disorderly / Disturbance

No person is to be disorderly or create a nuisance within the Port of Mackay, including small craft facilities. A person who acts in a disorderly manner or creates a nuisance may be directed to leave the port. This direction may include a direction not to re-enter the port or part of the port for twenty-four (24) hours. A person having been evicted from the port may be required to show cause why previous approval to enter should not be revoked.

3.3.2 False Representation

Persons must not falsely represent themselves as officers, employees, servants or agents of the Authority.

3.3.3 General Offence

No person is to intentionally or recklessly carry out or have carried out the following:

  • (a) Damage to Authority work or infrastructure.
  • (b) Interfere with or disrupt the port's operation.
  • (c) Dump refuse or goods at the port and its strategic land or into port waters.
  • (d) Evade payment of Authority charges.
3.3.4 Alcohol – Sale or Purchase

Sale of alcohol in the port without obtaining all relevant licences required at law and without first obtaining permission in writing from Mackay Port Authority is not permitted.

3.4 General

3.4.1 Approval to Operate Fuelling Facilities

It is an offence to operate a fuelling facility or otherwise distribute fuel in the port without written permission of the Authority or to breach a condition of the Authority's approval for a fuel facility.

3.4.2 Consent to Conduct Business

No person will conduct a business, hawk, sell, offer for sale or barter goods or services on a wharf, or elsewhere within the port, without first obtaining the written permission of the Authority.
