6. Incident Reporting

6.1 Oil Spill

A person or persons who deliberately, negligently or accidentally cause spillage of oil within port limits or who detects or witnesses a spillage must immediately notify the Authority. Notification should be made to the Authority's 24 hour telephone number: 4955 5107.

6.2 Marine Incident

An owner, Master or person in charge of a ship must immediately report any marine incident within port limits, including the grounding, collision or sinking of a ship to the Regional Harbour Master and to the Authority. Failure to report an incident or to delay reporting is an offence.

6.3 Statute Requirements

It is the responsibility of users, owners, Masters of ships or organisations to report to the Division of Workplace Health and Safety, any incident which is classified as 'serious injury / dangerous occurrence incident' as defined under the Workplace Health and Safety Act 1995. The Authority should be informed if it directly or indirectly affects the port and its operations.

6.4 Environmental Incident Reporting

Incidents with potential to cause or which have caused environmental harm as defined in the Environmental Protection Act 1994 within the port including land and facilities under the control of Mackay Port Authority must be reported to the Authority as soon as reasonable practicable. Failure to report an incident is an offence.

It is the responsibility of users, owners, Masters and organisations to notify the Environmental Protection Agency and / or Mackay City Council where the incident is of the nature that requires notification under the Environmental Protection Act and Environmental ProtectionPolicies.
